1. Subject matter
These terms govern the use of the Selfcare service, human resources and payroll software made available as a service on the internet by Selfcare, Lda., legal person no. 510803890, with registered office at Av. Duque D'Ávila n.º 46, 3.º A, 1050-083 Lisboa ("Selfcare").
The "customer" is the company or accounting firm that creates an account and subscribes to the service. The Selfcare service is intended for professional use: by creating the account, the person doing so declares that they have the authority to bind the customer to these terms.
2. Account and users
- The customer invites its users (owners, HR, managers, employees and accountants) and assigns each one the role that defines what they can see and do.
- Each user signs in with their own account and is responsible for keeping their password and access to their email secure. Email verification at every sign-in is mandatory.
- The customer is responsible for the access it grants and must withdraw it when it is no longer justified, for example when an employee leaves.
- The customer must notify us immediately if it suspects unauthorised access, by writing to suporte@selfcare.work.
3. Subscription and payment
- The Selfcare service is subscribed to through annual licences, per active employee. The plans and prices in force are on the Pricing page, where the amount is shown per month, and the licence is paid in one go for the year. VAT at the statutory rate is added to the prices.
- There may be a free trial period, on the conditions stated on the Pricing page.
- Payment is made by card, through Stripe, or by whatever means is agreed in writing. For each payment a certified invoice-receipt (fatura-recibo) is issued, available in the account settings.
- The licence renews at the end of each year for an equal period, unless the customer cancels it beforehand. Cancellation takes effect at the end of the period already paid and does not give rise to a pro rata refund.
- Price changes are announced by 1 January and only take effect on 1 January of the following year.
- Accounts paid for by a partner accounting firm, or with negotiated conditions, follow what has been agreed in writing, which prevails over these terms where it differs.
4. Customer obligations
- Ensure that the data it enters (about employees, the company, contracts, salaries, absences and expenses) is accurate and up to date.
- Use the Selfcare service lawfully, have a legal basis for processing the personal data it places in it and inform its employees of that processing, as controller.
- Validate the results before using them. The Selfcare service calculates payslips (recibos de vencimento), IRS (personal income tax) withholdings and contributions and generates files such as the DMR (monthly pay return) for Segurança Social (Portuguese social security), the DMR-AT (monthly pay return to the tax authority) and SEPA transfers, but the decision to submit them to the Autoridade Tributária (tax authority), Segurança Social or the bank belongs to the customer or its accountant, who must check them before submission. The software helps; responsibility for returns and payments lies with whoever submits them.
- Not attempt to access other customers' data, circumvent limits or security measures, reverse engineer the service, or use it to send unlawful or abusive content.
5. Availability and support
We do our best to keep the Selfcare service available and working well, but we do not guarantee an uninterrupted or error-free service. There may be stoppages for maintenance, which we try to carry out outside working hours, and supplier failures beyond our control.
The product evolves: we may add, change or withdraw features. We do not withdraw an essential feature of the contracted plan during the period already paid without a reasonable alternative.
Support is provided by email, on working days. The details are on the Support page.
6. Data protection
As regards employee data, the customer is the controller and Selfcare acts as processor, under Article 28 of the GDPR. The data processing agreement (DPA) forms part of these terms. How we process personal data, the processors we use and the retention periods are set out in the Privacy Policy.
7. Intellectual property
The Selfcare service, its code, design, brand and documentation belong to Selfcare. The subscription gives the customer a non-exclusive, non-transferable licence to use it, during the contracted period, and does not transfer any right over the software.
The data the customer places in the Selfcare service remains the customer's. We use it only to provide the service, in accordance with the Privacy Policy.
8. Third-party integrations
The Selfcare service may connect to third-party services, such as Slack, sign-in with Google, Stripe for payments, or public API and MCP server clients authorised by the customer. These connections are optional and are also subject to the terms of those services.
When the customer activates an integration, it authorises the exchange of data needed for it to work. We are not liable for the availability or operation of third-party services, and we may change or discontinue an integration if the third party changes its conditions.
9. Limitation of liability
- Selfcare is liable for damage it causes through wilful misconduct (dolo) or gross negligence (culpa grave), in accordance with the law.
- Outside those cases, Selfcare's total liability to the customer, for any cause related to the service, is limited to the amount paid by the customer in the 12 months preceding the event that gave rise to it.
- Selfcare is not liable for loss of profits, loss of business or indirect damage, nor for fines (coimas), interest or charges resulting from returns, payments or data that the customer did not check before submitting or using them.
- Nothing in these terms excludes rights that the law does not allow to be set aside.
10. Suspension and termination
- The customer may cancel the subscription at any time, with effect at the end of the paid period.
- In the event of non-payment, and after notice, use of the Selfcare service may be restricted until the situation is regularised.
- We may suspend or terminate access, with prior notice whenever possible, if the customer seriously breaches these terms, uses the service unlawfully or puts at risk the security of the service or of other customers.
11. Data export at the end
During the contract, the customer may export its data at any time: employees in CSV, in the same format the importer reads, and payslips, mapas (payroll reports), returns and other reports in open formats. After the end of the contract, the data remains available for export for 30 days and is then deleted, except for what the law requires us to keep. As employer, it is for the customer to keep payroll and tax records for the legal periods.
12. Changes to the terms
We may change these terms. Relevant changes are communicated to customers at least 30 days in advance, by email or within the application. If the customer does not agree, it may cancel the subscription before the changes take effect.
13. Governing law and jurisdiction
These terms are governed by Portuguese law. The courts of the comarca (judicial district) of Lisbon have jurisdiction over any dispute, with waiver of any other.
